Via Michael Rothstein of ESPN.com, Troy Aikman and Lamar Jackson are battling over copyright issues related to the number they wore on the football field — eight.
Both appear to have legal protections for some form of the number. Recently, Jackson opposed Aikman’s attempt to use the number “eight” on clothing and bags, arguing that it was “likely to cause confusion, cause error, or deceive” the purchasing public as to whether they were buying products from Jackson or Aikman.
Jackson’s filing also states that he “has expended a great deal of time, effort and expense promoting, advertising and promoting the number 8 in connection with his persona and celebrity” and “is known for this number because of his celebrity, as well as his promotion of this number in his trademarks and in media coverage.”
Aikman has a beer brand called “eightJackson SellsThe eighth eraClothes.
Jackson’s papers were filed on July 9, and Aikman is scheduled to file his appeal on August 18.
Depending on how things unfold, it could lead to an awkward production meeting when the Ravens show up. Monday Night Football (where Aikman serves as an analyst) on October 21. And again on November 25.
